If you are a player, it is likely that at one time, you have wondered whether poker is legal in general or specific contexts. For example, is poker legal in private homes?

Besides the consideration of whether a game of poker is gambling, four other elements are often used to determine whether it is legal or illegal in a jurisdiction or context.

1. Money exchanging hands

In some jurisdictions, law enforcement can intervene only if players are betting actual money. A friendly poker tournament involving no money would be legal in such a jurisdiction.

It is possible to play poker without using actual money as an incentive. Chips, tokens, or points could be used to track bets and pots. While this removes the financial aspects of the game, it also removes a potent incentive to create the maximum excitement out of the game.

2. The house or host taking fees

In some jurisdictions, especially in the United States, it is legal to play poker and wage actual money as long as the event happens in a private venue such as a home or a private club and that the host does not make any profits from the game besides what they might earn by participating like the rest of the players.

3. Designation of venue by law

In some jurisdictions, it is the case that some special zones and locations are approved by the law to host and be used for gambling, including poker games. A great example is the Indian reservations in the United States, where the indigenous tribes are allowed to own and run casinos and other gambling ventures.

4. Online vs real world.

With the arrival of the Internet, poker became available virtually. That has created unique opportunities, challenges, and legal approaches. In some jurisdictions, online gambling has been banned even when real-world counterparts have not. For example, the United States has limited online payment solutions to support online gambling. However, in Australia, online poker games are specifically banned even though it is generally legal to play real-world poker in the country.

Is poker legal in India?

In general, Poker is considered a game of chance in India and, therefore, is regulated under the Act of Public Gambling Act 1867. Nevertheless, court rulings have considered it a game of skill and, therefore, not fit to be treated as gambling.

Like in the US, India has states, each creating local laws that affect different aspects of society, including gaming. So, the legality of poker games in India is inhomogeneous and varies from state to state.

It is also important to note that many online gaming platforms, for example, 7bet, in India are duly registered and operate within the limits of the law. A few of these do provide poker games.  

In general, the legality of poker is extremely complex. Not only is there not a single set of rules that are applied around the world, but even in the same country, the rules are different for different areas and situations.
